1. Accepting these Terms

By accessing or using any part of the Services (including browsing), you agree to these Terms. If you do not agree, do not use the Services.

2. Other documents & policies

These Terms incorporate other rules and policies that apply to your use of the Services, including:

3. Privacy

Your privacy matters. Our Privacy Policy explains how Lovecraftify processes personal data. Sellers may also process buyer information to fulfill orders and provide support, and are responsible for their own privacy compliance.

4. Accounts, eligibility & security

A) Eligibility

You must be at least 18 years old to create an account. If you are between 13 and 17, you may only use the Services through an account owned by a parent or legal guardian with their permission and supervision. Users under 13 may not use the Services.

B) Accurate information

You agree to provide accurate account information and keep it up to date. You may not impersonate others or use misleading identity information.

C) Account security

You are responsible for maintaining the confidentiality of your credentials and all activity on your account. Notify us promptly if you suspect unauthorized access.

5. Your content & intellectual property

A) Your Content

“Your Content” includes listings, images, videos, descriptions, reviews, messages, shop profiles, and other materials you submit. You are responsible for Your Content and represent that you have the rights to use it and that it does not violate any law or third-party rights.

B) License to operate the marketplace

You grant Lovecraftify a non-exclusive, worldwide, royalty-free license to host, display, reproduce, distribute, and format Your Content to operate, market, and improve the Services (for example, showing your listings in search, recommendations, or promotional placements).

C) IP complaints (DMCA / trademark)

If you believe content infringes your intellectual property, you may submit a notice via our IP/DMCA process. We may remove content and may suspend repeat infringers.

6. Your use of the Services

You agree not to misuse the Services. Prohibited conduct includes:

• Violating laws or regulations
• Posting prohibited items or illegal content
• Harassment, hate, threats, or abuse
• Fraud, chargeback abuse, or misleading listings
• Scraping, hacking, introducing malware, or interfering with the platform
• Trying to bypass fees or platform protections

7. Marketplace basics (buyers & sellers)

A) Marketplace role

Lovecraftify provides a venue for buyers and sellers to connect. Sellers are responsible for their listings, production, fulfillment, quality, customer service, and compliance. Lovecraftify does not manufacture items unless explicitly stated.

B) Buyers

Buyers are responsible for reading listing details, shop policies, and personalization requirements before purchase. You agree to provide accurate delivery information and communicate respectfully with sellers.

C) Sellers

Sellers must provide accurate listings, clear processing times, honest materials/attributes, and lawful products. If you use production partners for made-to-order/print-on-demand items, you remain responsible for quality, compliance, and customer support.

8. Fees, payments & taxes

A) Fees

Lovecraftify may charge fees for certain Services (for example: listing fees, transaction fees, payment processing fees, optional advertising). If fees apply, we will describe them on a Fees/Payments page or within seller onboarding.

B) Payments

Payments may be processed by third-party payment providers. You agree to comply with their terms. Lovecraftify may withhold payouts, delay transfers, or request verification where needed for fraud prevention or compliance.

C) Taxes

Sellers are responsible for determining, collecting, reporting, and remitting applicable taxes unless the law requires marketplace collection. We may collect certain information to support tax reporting obligations where required.

9. Digital items, shipping, returns & disputes

A) Digital downloads

Digital items are delivered electronically. Unless required by law or explicitly stated by the seller, digital purchases are generally non-refundable once delivered/downloaded due to the nature of digital goods.

B) Shipping & delivery (physical items)

Sellers set processing times and shipping methods. Estimated delivery dates are estimates, not guarantees. Sellers are responsible for packaging, tracking (where offered), and resolving delivery issues consistent with their policies and applicable law.

C) Returns & order issues

Return/refund policies vary by shop and product type. Buyers should review shop policies before purchase. If an issue arises, buyers and sellers should first try to resolve it through messaging. Lovecraftify may provide a case/dispute process in certain situations to help address unresolved issues.

D) Reviews

Reviews must be honest and based on genuine experiences. We may remove reviews that violate policy (e.g., harassment, extortion, or spam).

10. Suspension & termination

We may suspend or terminate accounts, listings, or access to the Services at any time if we believe you violated these Terms, created risk for the marketplace, or for legal/compliance reasons. You may stop using the Services at any time.

11. Disclaimers & limitation of liability

A) Disclaimers

The Services are provided “as is” and “as available” to the maximum extent permitted by law. Lovecraftify does not guarantee uninterrupted access, error-free operation, or that listings will meet your expectations. Sellers are responsible for their products and services.

B) Limitation of liability

To the maximum extent permitted by law, Lovecraftify will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from or related to the Services. Lovecraftify’s total liability for any claim will not exceed the amount you paid to Lovecraftify (if any) in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless Lovecraftify LLC and its officers, directors, employees, and agents from claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, Your Content, your products, or your violation of these Terms or law.

13. Disputes with other users

Disputes between buyers and sellers should first be handled directly between the parties. Lovecraftify may offer tools or a case process to help, but we are not obligated to resolve every dispute and do not act as a seller or buyer.

14. Disputes with Lovecraftify

If you have a concern, please contact us first so we can try to resolve it informally. Where permitted, you and Lovecraftify agree to attempt good-faith resolution before filing a formal claim.

Arbitration / class action waiver (optional)

Some marketplaces use binding arbitration and a class action waiver for certain regions. If you want this approach, you should have counsel finalize the exact wording (including opt-out procedures, forum, and governing rules) to match your jurisdiction and risk profile.

15. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will provide notice by posting an updated version and revising the effective date. Your continued use of the Services after changes become effective means you accept the updated Terms.

16. Other legal terms

• Governing law: These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of laws rules (unless your local law requires otherwise).
• Severability: If a portion of these Terms is found unenforceable, the remainder will remain in effect.
• No waiver: Failure to enforce a provision is not a waiver of our right to do so later.
• Assignment: You may not assign these Terms without our consent; we may assign them as part of a corporate transaction.
• Entire agreement: These Terms and incorporated policies are the entire agreement about the Services.
