DMCA & Copyright Policy

Lovecraftify LLC (“Lovecraftify,” “we,” “us,” “our”) respects intellectual property rights and expects our users to do the same. This page explains how to submit Digital Millennium Copyright Act (DMCA) notices and counter notices for content on https://lovecraftify.com/ (the “Services”).

1. Lovecraftify’s role

Lovecraftify is a marketplace with independent third-party sellers. Sellers are responsible for ensuring they have the rights to their listings, images, and other content they post. We may remove or disable access to material identified in a compliant infringement report, and we may request additional information or reject reports that appear false, incomplete, fraudulent, or submitted in bad faith. :contentReference[oaicite:2]{index=2}

2. How to report copyright infringement (DMCA notice)

If you are a copyright owner (or authorized agent) and believe content on Lovecraftify infringes your copyright, you may submit a DMCA notice to our Designated Agent. A DMCA notice must include all of the following. :contentReference[oaicite:3]{index=3}

Required information

  1. Signature: A physical or electronic signature of a person authorized to act on behalf of the copyright owner (you may type your full legal name).
  2. Work identified: Identify the copyrighted work claimed to be infringed (or a representative list, if multiple works).
  3. Infringing material location: Identify the allegedly infringing material and provide enough detail for us to locate it (e.g., listing URL(s), shop URL, and any relevant screenshots or item IDs).
  4. Contact information: Your name, address, telephone number, and email address.
  5. Good faith statement: A statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy & authority statement: A statement that the information is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

3. How to submit a DMCA counter notice

If your content was removed or disabled due to a copyright report and you believe this happened due to mistake or misidentification, you may submit a DMCA counter notice to our Designated Agent. Counter notices typically require statements made under penalty of perjury and are shared with the original complaining party. :contentReference[oaicite:4]{index=4}

Required information

  1. Signature: Your physical or electronic signature (you may type your full legal name).
  2. Material identified: Identify the material removed/disabled and provide the specific location it appeared before removal (e.g., listing URL(s) or page URL(s)).
  3. Perjury statement: A statement under penalty of perjury that you have a good faith belief the material was removed/disabled due to mistake or misidentification.
  4. Your contact information: Your name, address, telephone number, and email address.
  5. Jurisdiction & service of process: A statement consenting to the jurisdiction of the Federal District Court for your address (or, if outside the U.S., a U.S. Federal District Court where Lovecraftify may be found), and that you will accept service of process from the complaining party (or their agent).

4. What happens after we receive a notice or counter notice

A) After a compliant DMCA notice

  • We may remove or disable access to the identified material.
  • We make reasonable efforts to notify the affected user and may share the report (including reporter contact details) with them. :contentReference[oaicite:6]{index=6}
  • We may request additional information before processing and may reject notices we believe are false, incomplete, or submitted in bad faith. :contentReference[oaicite:7]{index=7}

B) After a compliant counter notice

  • Unless the complaining party notifies us of legal action seeking to restrain the allegedly infringing activity, the removed material may be restored after a waiting period (commonly at least 10 business days after processing). :contentReference[oaicite:9]{index=9}
Privacy note: DMCA notices and counter notices include personal contact information and may be shared with the other party as required by the DMCA process.

5. Repeat infringement

In appropriate circumstances and at our discretion, Lovecraftify may suspend or terminate selling privileges (or accounts) for users who are subject to repeat or multiple notices of intellectual property infringement. We may also refuse service to new accounts we believe are associated with a previously terminated user. :contentReference[oaicite:10]{index=10}

6. Withdrawals

We generally only accept withdrawals of infringement reports from the original copyright owner or an authorized representative. A withdrawal should clearly identify the report and the affected material (e.g., listing URL(s) and shop name). 7. Misrepresentations & misuse

Submitting false or misleading notices or counter notices can have serious consequences. If you knowingly misrepresent that material is infringing (or not infringing), you may be liable for damages, including costs and attorneys’ fees. 8. Trademark & other IP (non-DMCA)

The DMCA process is designed for copyright claims. If your concern relates to trademarks, patents, or other rights, we may still accept reports and take action under our marketplace policies, but the DMCA counter notice process may not apply to those claims.
